UNDANG-UNDANG CIPTA KERJA DAN STRICT LIABILITY

Abstract


ABSTRAK
Sejak tahap penyusunan sampai pengundangannya, UU Ciptaker telah mengundang banyak kritik dari berbagai kalangan. Salah satu kritik yang mengemuka adalah pandangan yang menyatakan bahwa UU ini telah menghapuskan, atau setidaknya, mengaburkan makna strict liability. Artikel ini hendak membantah kedua pandangan tersebut. Pertama, dengan memperlihatkan bahwa rumusan di dalam UU Ciptaker masih mengadopsi strict liability. Kedua, dengan menunjukkan bahwa kekhawatiran rumusan UU Cipta Kerja akan mengaburkan makna strict liability merupakan pandangan yang tidak tepat sasaran. Kekaburan makna strict liability selama ini bukan disebabkan oleh perumusan pasalnya, tetapi lebih merupakan akibat kekeliruan yang telah terjadi jauh sebelum UU Ciptaker: miskonsepsi yang menganggap strict liability masih didasarkan pada adanya unsur melawan hukum dan miskonsepsi bahwa strict liability adalah pembuktian terbalik unsur kesalahan. Perubahan makna strict liability terjadi bukan melalui UU Ciptaker, tetapi melalui peraturan pelaksananya, yaitu PP Nomor 22 Tahun 2021.

ABSTRACT
Since the beginning, the Omnibus Law on Job Creation has invited many critiques from various interests. Two of the criticisms argue that the Omnibus Law has abolished strict liability on the one hand, or at least obscured the meaning of strict liability on the other hand. This paper seeks to refute both views. This paper shows that the formulation in the Omnibus Law still adopts strict liability. Meanwhile, the argument that the formulation of the Job Creation Law will obscure the meaning of strict liability aims at a wrong target. Ambiguities in the implementation of strict liability so far are not the result of its formulation in the Law, but rather the result of various misinterpretations that have emerged long before the enactment of the Omnibus Law, most notably the misconception that strict liability is based on the existence of unlawfulness and that strict liability is identical with the shifting in the burden of proof with respect to fault. The change in the meaning of strict liability occurs not through the Omnibus Law but through its implementing regulation, namely the GR Number 22 of 2021.
