Abstract

ABSTRACT

Joint use of civil and military airports practice has been initiated in Indonesia since relatively long time ago, particularly, the use of military airfields as pioneer airport in remote areas which have accessibility limitation of land or sea. The area is relatively difficult to be developed without the pioneer airport. Indonesia has promulgated the Government Regulation Number 40 of 2012 concerning the Development and Preservation of Airport Environment (hereinafter referred to as PP No. 40 of 2012). Some legal problems arise from the absence of special regulatory norms that explicitly regulate civil-enclave airport in the law. Therefore, the compatibility of the norm in PP No. 40 of 2012 is needed to be reviewed, especially the environmental conservation issues in joint-use airport. According to the research explained in this article, the norms under Government Regulation No. 40 of 2012 can still be implemented in joint-use airports, despite the absence of specific norms regulated this type of airport.
